Somerton Home Furnishings Limited Warranty
CASE GOODS PRODUCT INFORMATION ONE-YEAR LIMITED WARRANTY

Furniture: Somerton Home Furnishings, Inc. warrants to the consumer who makes the original purchase of Somerton furniture from an authorized Somerton dealer that, except as to the fabric, the furniture is free from defects in workmanship material and construction for one year from the date of purchase. In the event that a defect is found, Somerton will either repair or replace the defective item or substitute a different item, in its sole discretion.

Fabrics: Manufacturers of upholstery fabrics do not warrant their products for wearability or colorfastness. While Somerton makes every effort to select only fabrics that are durable and colorfast, we regret that we will be unable to honor adjustments, claims, or credits for these properties. This warranty will be effective only if the consumer who originally purchases this furniture retains the original sales receipt showing purchase date and items of sale. This warranty is not transferable. This warranty applies under conditions of normal household use, but does not apply to defects that result from negligence, misuse, accidents, or commercial use, nor does it warrant the wearability or colorfastness of finishes or fabrics.

Wood Furniture: It is important to keep in mind that no two pieces of wood furniture are identical. Hereditary and environment can effect a tree before harvesting, influencing the grain structure and density. Natural variations in the color and texture of the wood are therefore not defects covered by this warranty. Likewise, fine hairline cracks are part of the normal aging process of wood veneers and are also not defects covered by this warranty.

Claims: Any claim against this warranty must initially be presented to the authorized Somerton dealer, along with dated proof of purchase, and the authorized Somerton dealer will then contact Somerton. Repair, replacement, or substitution will be made as soon as practical.

THE REMEDIES PROVIDED IN THIS WARRANTY ARE EXCLUSIVE AND TO THE EXTENT ALLOWED BY LAW ARE IN LIEU OF ALL OTHER REMEDIES, WARRANTIES, OR REPRESENTATIONS, EXPRESS OR IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHER OBLIGATIONS AND LIABILITIES, WHETHER IN CONTRACT OR IN TORT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED HEREIN. IN NO EVENT SHALL SOMERTON BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR OTHER DAMAGES. This warranty gives you specific legal rights, and you may have other rights that vary from state to state. Some states do not allow the exclusion of implied warranties or the limitation of damages, so the above exclusions and limitations may not apply to you. In the event the warranty exclusions do not apply to you, then, where legally permissible, such implied warranties are limited in duration to the stated warranty period and no warranties apply after that period. In circumstances in which the warranty provided herein does not apply, the products involved are, where legally permissible, still subject to the above disclaimer of implied warranties and the above limitations of damages. Somerton does not authorize anyone, including its dealers, to create for it any other warranty, obligations, or liability in connection with this product.
